The head lease is for a tenure of up to 9 September 2072 including extension and renewal by presidential decree.

This sale is a sublease transaction from a foreign entity to another foreign entity. There should not be any taxes or duties chargeable under Indonesian law. However, relevant stamp duty or taxes may apply depending on the location of execution of the sublease.
There is annual allocated property tax which is based on appraised value by government. As an indication, the allocated annual property tax for a Bayfront Pool Villa in 2006 was approximately US$ 600.
Your sale to another foreigner could be on a sublease or by assignment of your current sublease. In either case, there will be no tax issue in Indonesia as long as both you and the buyer is not a tax resident in Indonesia.
Banyan Tree Residences offer a unique investment opportunity. As condition of sale, owners enter into a Villa Management Agreement with the Banyan Tree, under which owners can receive a 33% of the net room revenue generated by the villa.
Any income remittance from Indonesia to overseas is subject to a 20% of withholding tax. However, since this is a sublease transaction between the buyer and Singapore company, a Singapore withholding tax of 20% will generally apply.
PT Bintan Hotel which is an Indonesian registered company will pay to Banyan Tree Properties Pte. Ltd. (BTP) which is registered in Singapore. Rental return will be paid to BTP subject to Indonesian withholding tax. BTP will in turn pay to the buyer less applicable tax suffered by BTP.
The Banyan Tree provides owners with a full management package and these services (such as housekeeping, pool cleaning, gardening, routine and preventative maintenance, general repairs and pest control) are included as part of the rental programme.
As an owner of a Banyan Tree Residence in Laguna Bintan, you may be entitled to a regular membership of Laguna Bintan Golf Club. In addition, owners will receive membership to the exclusive Banyan Tree Residence Club, providing residents with discounts at all Banyan Tree, Angsana and Colours of Angsana Resorts and Hotels, restaurants and spas (terms and conditions apply).
Owners are entitled to 60 days complimentary use of their villa every year. These ‘stay entitlements’ can be swapped amongst owners using the Exchange Programme, which provides access to a wide range of premium resorts in all Banyan Tree Residence destinations (currently Bintan, Phuket, Bangkok, and Lijiang).
Our current policy is that if you buy the property in your name: you, your legal spouse and your children (who are not over 21 years of age) will be entitled to the Golf Club membership. However, only one person can be registered for the Golf Club membership. If the owner of the property is a company, a director must nominate which person will receive the membership.
Infrastructure facilities, services and common area costs are absorbed by the Banyan Tree as part of their normal operating costs. All services are of the highest standard, are provided by the Banyan Tree hotel and include:

Roads, paths and fences: all private and internal roads, paths and fences are maintained by the Banyan Tree.
